06/06.01.2025 Heard Mr. P.A.N. Roy, learned counsel appearing for the petitioner and Mr. Anil Kumar, learned ASGI for the Opposite Party.
This application has been preferred by the petitioner for modification of the order dated 14.06.2023 passed in B.A. No. 1106 of 2023, wherein the petitioner was granted bail subject to the condition that he was to remain physically present before the leaned trial court on each and every date till the conclusion of the trial. The petitioner is basically aggrieved with that part of the order dated 14.06.2023 passed in B.A. No. 1106 of 2023 regarding his physical presence on each and every date till the conclusion of the trial.
It has been submitted by the learned counsel for the petitioner that the petitioner is aged more than 60 years and he is suffering from several ailments including carcinoma of urinary bladder for which he was operated upon. It has been submitted that the petitioner is also suffering from several other ailments and in fact the petitioner has diligently followed the directions passed by this Court on 14.06.2023 in B.A. No. 1106 of 2023.
Mr. Anil Kumar, learned ASGI for the Opposite Party has opposed the prayer made by the petitioner in this application.
There does not appear to be any dispute with respect to the appearance of the petitioner on a regular basis physically before the learned trial court which is in consonance with the order dated 14.06.2023 passed in B.A. No. 1106 of 2023. The medical condition of the petitioner appears to be serious as he was suffering from bladder cancer and several other ailments as highlighted by the
learned counsel for the petitioner.
In the circumstances noted above, therefore, the
order dated 14.06.2023 passed in B.A. No. 1106 of 2023 is modified to the extent that in the last paragraph of the said
order the direction that “the petitioner shall remain physically present before the learned trial court on each and every date till the conclusion of the trial” is modified to the extent that “the petitioner shall remain physically present as and when directed by the learned trial court”.
This application stands disposed of with the aforesaid modification in the order dated 14.06.2023 passed in B.A. No. 1106 of 2023.
