By way of present petition under Article 226 of the Constitution of India, the petitioner has sought for the following reliefs: “(A) YOUR LORDSHIP be pleased to issue appropriate writ, order or direction directing the Ld. Addln. Sr. Civil Judge & ACJM, Rajkot to expedite the proceedings of Criminal Case No.9961 of 2013 and take decision in accordance with law at the earliest within such stipulated time as may be deem fit by this Hon’ble Court in the interest of justice and equity; (B) YOUR LORDSHIP be pleased to direct the Ld. Addln. Sr. Civil Judge & ACJM, Rajkot to proceedings with the trial from the stage of R/SCR.A/14583/2023 ORDER DATED: 16/06/2025 leading of evidence of prosecution and conclude the trial of Criminal Case No.9961 of 2013 considering the principles of speedy trial laid down by the Hon’ble Apex Court and in accordance with law in the interest of justice and equity;” Perusing the report, it appears that the learned 14th Additional Senior Civil Judge and Additional Chief Judicial Magistrate, Rajkot has submitted the report dated 21.12.2023 stating that he has accepted the request made by the petitioner to expedite the trial. Considering the aforesaid fact, learned trial Court is directed to expedite the trial pursuant to the direction given by the coordinate Bench vide order dated 15.02.2023 passed in Special Criminal Application No.9878/2022. With aforesaid direction, present petition is disposed of. Rule is discharged. In view of disposal of SCR.A No.14583/2023, Criminal Misc.
