For Petitioner(s): M/s.N.D.Sivakumaran For Respondent(s): M/s.Dwarakesh Prabhakaran https://www.mhc.tn.gov.in/judis WP No. 47429 of 2025 __________ Page2 of 4 Order This Writ Petition is filed for a Mandamus directing the respondent to consider and dispose of the petitioner's representation dated 18.11.2025 wherein the petitioner has sought (i) abeyance order against the freezing order issued against petitioner's bank accounts (ii) issuance of revocation letter to petitioner's convertor M/s.Sri Murugan Spinning Mills, Coimbatore and (iii) acceptance of the petitioner's assurance to settle the remaining EPF dues within the extended period sought, namely upto March, 2026 on merits within a time period fixed by this Court. 2. The case of the petitioner is that it is a Government of Puducherry undertaking supporting the livelihood of around 300 employees and facing severe financial stress. Despite sustained efforts and continuous financial assistance from the Government of Puducherry, the respondent - EPFO has issued successive attachment orders, prohibitory orders and third party notices under Section 8F of the EPF Act, including freezing of the petitioner's bank accounts, crippling the day today functioning of the Mill. The petitioner has already remitted Rs.1 Crore through Government Grants-in-Aid and an appeal pending against before the CGIT in respect of the disputed damages portion. The petitioner submitted detailed representations dated 10.11.2025 and 18.11.2025 requesting abeyance of the freezing orders and seeking time to clear https://www.mhc.tn.gov.in/judis WP No. 47429 of 2025 __________ Page3 of 4 the balance dues. However the respondent has not considered or disposed of the petitioner's representation and hence, the present writ petition. 3. Heard the learned counsel for the parties and perused the materials. 4. Considering the limited scope of prayer sought for, this Court, without expressing anything on merits, directs the respondent to consider and dispose of the petitioner's representation dated 18.11.2025 and pass appropriate orders on merits and in accordance with law, within a period six weeks from the date of receipt of a copy of this order. 5. With the above directions, this Writ Petition stands disposed of.
