JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 2 20-08-2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Chautarwa P.S Case No. 87/2024 dated 24.03.2024 registered for the offence punishable u/s 395, 397 and 398 of the Indian Penal Code and Section 27 of the Arms Act. 3. As per the prosecution case, four miscreants riding on two motorcycles intercepted the vehicle of the informant and on the point of pistol and snatched the valuable including a cash of Rs. 20,000/-. On protested, the miscreants fired upon them, due to which the driver Md. Yasir and Md. Raju sustained bullet injury. Patna High Court CR. MISC. No.57023 of 2025(2) dt.20-08-2025 2/3 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Pappu Kumar and at his instance, three country-made katta, four live cartridges and one black colour purse were recovered. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 21.09.2024 passed in Cr. Misc. No. 48637/2024. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.06.2025. 5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. 6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bagaha, West Champaran in connection with Chautarwa P.S Case No. 87/2024.
