There is a delay of about 667 days in filing the present Letters Patent Appeal No. 634 of 2021. The cause of action accrued to the appellant in filing the present LPA No. 634 of 2021 is 03.01.2020. If the COVID-19 period is taken into consideration from 15.03.2020 to 30.09.2021 in that event delay would be about one month and few days. Patna High Court L.P.A No.634 of 2021 dt.04-03-2025 2/3 3. In the light of these facts and circumstances delay of about 667 days in filing LPA No. 634 of 2021 is condoned. Accordingly, I.A. No. 01 of 2021 stands allowed. 4. With the consent of learned counsel for the appellant, matter is taken up for final disposal. 5. The Appellants-State have assailed the order of the learned Single Judge dated 04.12.2019 passed in CWJC No. 03 of 2019. For the first time, the appellant is bringing notice to this Court that there is an order of Government of Bihar dated 17.05.1997 vide Letter No. 11/R3-305/97-980/ to follow certain directions. This document was not apprised before the learned Single Judge and for the first time it is pointed out in the present Letters Patent Appeal. Therefore, it is not a fit case for filing of Letters Patent Appeal. On the other hand, Appellants-State have remedy of filing civil review before the learned Single Judge.
