Learned Advocate, Mr. Patadia, appearing for the petitioner, under the instructions, submitted that the petitioner had preferred an application for deletion of his name from the complaint made under Section 138 of the Negotiable Instruments Act, which is rejected by the concerned Court and therefore, he seeks permission to withdraw this petition with a view to challenge the aforesaid order without arguing the matter on merits. 2. Heard. Permission, as prayed for, is granted. This petition stands disposed of, as withdrawn. It is clarified that this Court has not examined the merits of the mater and therefore, as and when an application is filed, the concerned Court shall examine the same on its own merits without being influenced by the present withdrawal.
