The petitioner through instant petition under Articles 226 and 227 of the Constitution of India is seeking direction to respondent to grant him consequential benefits i.e. seniority, pay, leave as per judgment dated 02.11.2022 passed by this Court in CWP-5981-2017 titled as Jagdeep Singh vs. State of Punjab and another. 2. The petitioner claims that this Court vide order dated 02.11.2022 in the case of petitioner himself has directed the respondent to grant benefit of seniority, pay, leave with effect from the date, when person lower in merit to him had been so appointed to the post of Constable in the same very process of selection. Despite said order, the respondent has not granted him benefit of seniority and pay. The operative portion of order dated 02.11.2022 is reproduced as below:- Shivani Gupta 2025.05.29 10:29 CWP-16045-2025 2 “11. In the light of the foregoing discussion, denial of appointment to the petitioner herein is held to be unjustified and the said action of the respondents is liable to be set at naught. For the reasons recorded above, the present writ petition is allowed. The impugned order dated 19.01.2017 (Annexure P-5) is set aside. Respondents are directed to issue an appointment letter to the petitioner herein for the post of Male Constable in the light of his merit position, within a period of eight weeks from the date of receipt of certified copy of this order. The petitioner is also held entitled to all the consequential benefits in the nature of seniority, pay, leave etc. with effect from the date, when person lower in the merit to him had been so appointed to the post of Constable in the same very process of selection. It is, however, clarified that the petitioner herein shall not be paid the actual arrears of salary for the period in question.” 3. There is specific order in favour of petitioner with respect to seniority, pay, leave etc. Thus, there is no question to pass fresh order directing the respondents to grant aforesaid benefits. 4. Faced with this, Mr. Ankit Grewal seeks permission to withdraw instant petition with liberty to approach authorities. 5.
