Ojha, Ms. Deepti Priya ..for the State This suo motu contempt proceeding has been initiated pursuant to communications received from certain merit-listed candidates in the Common Entrance Test for Medical and Allied Sciences Postgraduate Courses (JEMAS-PG) 2024, as well as from the West Bengal Joint Entrance Examination 2 Board, which were addressed to my personal e- mail. Heard the parties. Mr. Bandopadhyay, learned senior advocate, submits that no further steps shall be undertaken with respect to any admission process conducted by the West Bengal Joint Entrance Examination Board in violation of the order dated May 21, 2025, passed by this Court until the stay application is decided by the Division Bench of this Court against the said order. This Court expresses its surprise and concern at the manner in which the State has acted in violation of the order dated May 22, 2024, passed by the Division Bench of this Court in WPO 60 of 2011 (Amal Chandra Das v. The State of West Bengal and Ors.) and other connected matters, despite the fact that no stay has been granted by the Hon’ble Supreme Court. In view of the significance of the matter, the Principal Secretary, Higher Education Department, West Bengal, is directed to remain present online tomorrow (07.08.2025) at 10:30 a.m. to apprise the Court of the State’s position. Until then, no further steps in the admission process, including counselling, shall be undertaken by the respondents. 3 The Department is directed to provide the appropriate case number for this proceeding.
