JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 18-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Daudnagar Excise P.S. Case No. 208 of 2025, instituted under Section 30(a) of the Bihar Prohibition & Excise Act. 3. There is recovery of 14 litre country made liquor from the dicky of the motorcycle of the petitioner which was driven by co-accused Ajay Kumar @ Jai Hind Kumar, who was apprehended on the spot. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to the reason that he is the owner of the seized vehicle. Petitioner as on good faith gave the said motorcycle to the co- accused and he had no knowledge about the mis-deed of the co- Patna High Court CR. MISC. No.53476 of 2025(2) dt.18-08-2025 2/2 accused. Petitioner has no criminal antecedent. He undertakes to co-operate in the investigation and trial. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail. 6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge of Excise-II, Aurangabad in connection with Daudnagar Excise P.S.
