In this writ petition, the petitioner has prayed for direction to make payment of retiral dues i.e. Pension, Gratuity, Leave Encashement, Group Insurance, Arrear of salary of 19th month (from January 2003 to July 2003 (7th Month), February 2015 and April, 2015 to February, 2016), arrear of 7th pay revision, 1st ACP, 2nd and 3rd MACP benefit to the petitioner (retired on 31.01.2019) with interest @ 18% & cost for which he is legally entitled as per the law. 3. Learned counsel for the petitioner submits that the amount under the aforesaid head and for the aforesaid period has not been paid to the petitioner though he has superannuated way back on 30.01.2019. He submits that he has already represented before the Deputy Commissioner, Seraikella-Kharsawa, but no action has yet been taken further the C.O. has also not taken any steps to make payment. 4. Learned counsel for the State submits that if a fresh representation is filed before the Deputy Commissioner, Seraikella- Kharsawa, the Deputy Commissioner, Seraikella-Kharsawa will pass an appropriate order and will look in the matter itself and will ensure that the amount which the petitioner is legally entitled to receive, will be paid to him. 5. Considering the said submission, I direct the petitioner to file the representation before the Deputy Commissioner, Seraikella-Kharsawa along with all the documents within four weeks from today. On receipt of the said representation, the Deputy Commissioner, Seraikella- Kharsawa will take a decision on the same within six weeks. If the petitioner is entitled to receive the same, the same will be disbursed to him within four weeks thereafter. 6. The writ petition stands disposed of. (ANANDA SEN, J.) R.S.
