CRM(A) 4099 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gangarampur P.S. Case No.11 of 2025 dated 05.01.2025 under Sections 21(c)/22(c)/27A/28/29 of the NDPS Act. And
In the matter of: Mizanur Rahaman @ Mijanur Rahaman and another … petitioners
Mr. Kaushik Choudhury
Mr. D. Panda … for the petitioners
Mr. Antarikhya Basu
Mr. Sandip Kundu
... for the State
Learned counsel for the petitioners submits that other than the statement of a co-accused there is no other material available against the present petitioners.
Learned counsel for the State relies on a document which is taken on record, and submits that there are criminal antecedents against the present petitioners involving offences under the NDPS Act. Besides, a proclamation and attachment has been issued on 18.08.2025 against the present petitioners. Considering the materials available in the case diary, the criminal antecedent of the petitioners, the fact that a proclamation has been issued against the petitioners and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.
