(Oral) Applicant Madan Singh is in judicial custody in FIR No. 0224 of 2020 under Sections 147, 148, 149, 304, 307 IPC, Police Station Gadarpur, District Udham Singh Nagar. He has sought his release on bail. 2. This is third bail application of the applicant. His first bail application and second bail application have already been rejected on 27.09.2021 and 01.04.2024, respectively. 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant submits that the applicant is in custody for more than five years; out of total 25 prosecution witness, only 4 witness have been examined; the applicant has not delayed the trial at any stage. 5. Learned State Counsel admits these facts. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 2 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
