2025:KER:29092 IN THE HIGH COURT OF KERALA AT ERNAKULAM PRESENT THE HONOURABLE MR. JUSTICE DEVAN RAMACHANDRAN & THE HONOURABLE MRS. JUSTICE M.B. SNEHALATHA FRIDAY, THE 4TH DAY OF APRIL 2025 / 14TH CHAITHRA, 1947 OP (FC) NO. 207 OF 2025 AGAINST THE ORDER IN OP(OTHERS) NO.395 OF 2022 OF FAMILY COURT,KOLLAM PETITIONER/PETITIONER IN OP: DR.AHANA S, AGED 28 YEARS, D/O.SHAJAHAN, PANDALAYIL, VADAKKKEVILA P.O., VADAKKEVILA VILLAGE,KOLLAM, PIN - 691010 BY ADVS. B.MOHANLAL P.S.PREETHA ASWIN V. NAIR KARTHIK J SEKHAR ABIJITH M. AVANI NAIR JAYAPRABHA ARJUN PRAVEENA T. RESPONDENT/RESPONDENT IN OP: AJMAL, AGED 31 YEARS, S/O.JAMALUDHEEN KUNJU, VANIYATHIL PUTHEN VEEDU, PORUKKARA, EDAPPALLYKOTTA P.O.,PANMANA VILLAGE, CHAVARA, KOLLAM, PIN - 691583 THIS OP (FAMILY COURT) HAVING COME UP FOR ADMISSION ON 04.04.2025, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: 2025:KER:29092 OP(FC) 207/25 2 JUDGMENT Devan Ramachandran, J. Even though the petitioner singularly pleads that the learned Family Court, Kollam, be directed to dispose of OP(Others)No.395/2022 and M.C.No.225/2022 within a time frame to be fixed by this Court, her learned counsel – Sri.B.Mohanlal, conceded that his client has already moved Exts.P3 and P4 application for such purpose before the said Court. 2. Obviously, we cannot intervene at this stage; and as we have been consistently saying in such matters, it would not be prudent for us to fix any time frame for the learned Family Court to dispose of matters finally, since we are fully aware of the workload that it endures. 3. However, since the petitioner says that she has preferred Exts.P3 and P4 applications, we are of the view that we will be justified in directing the learned Family Court to dispose of the same, after hearing both sides. 2025:KER:29092 OP(FC) 207/25 3 In the afore circumstances, we allow this Original Petition to the limited extent of directing the learned Family Court to take up Exts.P3 and P4 applications – if they are still pending; and dispose of the same, after affording necessary opportunities to both sides; thus culminating in an appropriate order thereon, as expeditiously as is possible, but not later than one month from the date of receipt of a copy of this judgment. Needless to say, even though we have not fixed any time frame for disposal of OP(Others)No.395/2022 and M.C.No.225/2022 by the learned Family Court, it will be up to it to choose to do so as per law, adverting to all relevant and germane aspects.
