1. The following prayers have been made in the writ petition:
"I. Issue a writ, order or direction in the nature of mandamus directing to the Respondent No.3/4 to decide the representation of the petitioner dated 22.05.2025 regarding demolition of which her village house situated in Village- Mundiya, Rasoolpur, Tehsil- Tanda, District- Rampur over the land/Arazi No.323 situated in Village/GramPanchayat- Mundiya, Rasoolpur, Tehsil- Tanda, District- Rampur. II. Issue a writ, order or direction in the nature of mandamus directing to the Respondents to not demolish the old Village house of the petitioner since situated in Village- Mundiya, Rasoolpur, Tehsil- Tanda, District- Rampur."
2. The submission of learned counsel for the petitioner is that the functionaries of the State are threatening to demolish the pucca constructions of the petitioner.
3. Learned Standing Counsel points out that in the representations filed by the petitioner, he has admitted that proceedings under Section 67 of U.P. Revenue Code, 2006 are pending against her. He submits that, in such circumstances, the case set-up in the writ petition cannot be accepted.
4. As proceedings under Section 67 are stated to be pending, therefore, we have no doubt that the respondents would not take any coercive action against the petitioner unless eviction of the petitioner is directed in the said proceedings.
5. We, therefore, find no good reason to direct the respondents to decide any representation filed by the petitioner in this behalf.
6. Subject to the aforesaid observations, the petition stands disposed of. (Ram Manohar Narayan Mishra, J.) (Manoj Kumar Gupta, J.) Order Date :- 11.7.2025 Ankit. Digitally signed by :- ANKIT VISHWAKARMA High Court of Judicature at Allahabad
