Neutral Citation No. - 2025:AHC:84830 Court No. - 87 Case :- APPLICATION U/S 482 No. - 17071 of 2024 Applicant :- Alok Opposite Party :- State Of U.P. And Another Counsel for Applicant :- Brij Bhushan Upadhyay Counsel for Opposite Party :- G.A. Hon'ble Prashant Kumar,J. 1. None appears on behalf of the applicants even in revised call. Learned AGA is present on behalf of the State respondents. 2. Heard learned AGA and perused the record. 3. The instant application under section 482 Cr.P.C. has been filed for quashing the summoning order dated 02.05.2023 including entire criminal proceeding of Complaint Case No.13907 of 2021 (Smt. Vishwa Mohini Mishra v. Alok and others), under Sections 406 I.P.C., Police Station- Shahganj, District-Agra pending in the court of Additional Civil Judge (Junior Division), Court No.9, Agra. 4. This court vide order dated 20.06.2024 had referred the matter for mediation, however, the report submitted by the Mediation Center reflects that the applicants have not deposited the mediation amount as fixed by the Court, hence, the notice could not be issued to opposite party no.2. 5. Considering the above situation it is apparent that the applicant has shown no sincerity for Mediation, but has purely abused the interim order of this Court, which he got, giving an impression to the Court that he sincerely wanted Mediation. 6. Apart from it, I have gone into the merits of the instant application, and find that the instant application is devoid of any merit. 7. Accordingly, the instant application is dismissed. 8. Interim order, if any, stands discharged. Order Date :- 20.5.2025 S.P. Digitally signed by :- SANJAY PURI High Court of Judicature at Allahabad
