Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 14/02/2025 1. Matter comes upon an application filed under Section 528 of BNSS by learned counsel for the petitioners stating that by vide order dated 17.01.2025, bail application was allowed under Section 482 of BNSS but inadvertently due to typographical mistake, the bail application was decided under Section 483 of BNSS. 2. Heard and perused the order dated 17.1.2025. 3. From the perusal of the record, it is apparent that the petitioners applied under Section 482 of BNSS for granting of anticipatory bail application but by vide order dated 17.01.2025 [2025:RJ-JP:6586] (2 of 2) [CRLMA-78/2025] instead of Section 482 of BNSS, Section 483 of BNSS has been written. The order dated 17.01.2025 is hereby recalled. The anticipatory bail application of all the three petitioners preferred under Section 482 of BNSS is allowed on the grounds that they have been implicated solely on the disclosure statement of the other co-accused. The matter is exclusively triable by Magistrate and the petitioners are ready and willing to cooperate with the investigation. 4. Accordingly, the anticipatory bail application under Section 482 of BNSS is allowed and it is ordered that in the event of arrest of the petitioners namely- 1. Amjad S/o Patmal Khan, 2. Mufid S/o Iliyas and 3. Momin S/o Aslam, in connection with FIR No. 172/2024 registered at Police Station Kaithwada, District Deeg, they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the petitioners shall not leave India without previous permission of the court.
