Court No. - 91 Case :- CRIMINAL REVISION No. - 2898 of 2025 Revisionist :- Neeraj @ Puppi Opposite Party :- State of U.P. and Another Counsel for Revisionist :- Maha Prasad,Sanjay Kushwaha Counsel for Opposite Party :- G.A. Hon'ble Sandeep Jain,J. The learned counsel for the accused-revisionist was heard partly and when the learned counsel failed to convince the Court regarding the illegality of the impugned order, then learned counsel submitted that he wants to not press this criminal revision. Accordingly, this criminal revision is dismissed as withdrawn. It also appears that initially in this case, the accused Neeraj @ Puppi was enlarged on bail in Case Crime No. 12 of 2025, under Sections 326(g), 352, 351 (2) of the B.N.S., 2023, P.S. Sardhuva, District Chitrakoot by the Court of Ms. Sonam Gupta, A.C.J.M./Civil Judge (S.D.)/FTC, Chitrakoot vide order dated 10.03.2025. It is apparent that the offence under Section 326(g) B.N.S. is punishable with life imprisonment and triable by Sessions Court, and therefore, the Magistrate had no jurisdiction to decide the bail application of the accused under Section 480 of B.N.S.S., 2023, but still the Magistrate has illegally exercised that jurisdiction by deliberately brushing aside the objection of Govt. Counsel and has granted bail to the accused, which has been rightly cancelled by the Sessions Judge, Chitrakoot vide impugned order dated 16.04.2025. The District Judge, Chitrakoot is directed to obtain an explanation in this regard from the concerned Judicial Officer and then submit it along with his report to the Administrative Judge concerned for taking necessary action in this matter, if deemed appropriate. Let a copy of this order be also communicated to the Administrative Judge concerned. Registrar (Compliance) to send a copy of this order to the District Judge concerned.
