Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The petitioner by means of the present writ petition has prayed for the following relief:- "i. Issue a writ, order or direction in the nature of mandamus commanding and directing to the respondents to provide the Rasta 20 fit from one side of the police chauki/plot no.226 situated in village Hingaut Khedia, Pargana & District Agra to the petitioner and other owners of the plot no.225 situated in village Hingaut Khedia, Pargana & District Agra to reach on the main road so that justice may be done. ii. Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. iii. Award any cost of the petition to the petitioner." 3. The grievance of the petitioner is that plot of petitioner i.e. Gata No.225छ is adjacent to Gata No.226, and thereafter, there is a road. It is contended that petitioner has no other alternative passage except through Gata No.226 to reach the road, and petitioner is using the same for the last 23 years. In such view of the fact, petitioner has claimed easementary right and has prayed that a direction be issued to respondent no.2 to leave some space in the plot which can be used as path by the petitioner for the access to the road. 4. Sri Rajesh Kumar Pal, learned Standing Counsel on the basis of Versus Counsel for Petitioner(s) : Mohan Lal Pandey, Narendra Kumar Shukla, Nishi Kant Chaturvedi Counsel for Respondent(s) : Avinash Chandra Srivastava, C.S.C. Hari Om Soni .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) instruction, which is taken on record, states that a passage has already been left in plot no.226 by leaving 10 fit road from west. The instruction further states that the petitioner has an alternative path through Gata No.265 which is shown as 'Rasta' in the map annexed with the instruction. Relevant extract of the instruction is being reproduced herein below:- "मा० न्यायालय के आदेश के समादर में अवगत कराना है क्रम में जांच कराई गई। जांच से स्पष्ट है िक ग्राम िहगोट खेिरया तहसील सदर िजला आगरा में िस्थत गाटा संख्या 226 रकवा 0.1610हे0 राजस्व अिभलेख में श्रेणी 5 "बंजर" की भूिम दजर् है। मौके पर उक्त भूिम नगला सबला- कबीश मागर् पर िस्थत है, तथा मौके पर खाली है। उक्त भूिम पर गाटा संख्या 225 के खातेदारो के द्वारा अवैध कब्जा िकया गया था, िजनको तहसीलदार न्यायालय से वाद संख्या T202301010100507, T202301010100508, T202301010100510 के अंतगर्त िनयमानुसार बेदखल कर उक्त भूिम कब्जा मुक्त कराई गई थी। कायार्लय िजलािधकारी, आगरा के पत्रांक संख्या 1471/डीएलआरसी िदनांक 17 जून 2025 को ग्राम िहगोट खेिरया के खाता संख्य 331 गाटा संख्या 226 रकवा 0.1610 हे0 भूिम जो बंजर के रूप में दजर् है, का पुिलस चौकी िनमार्ण हेतु पुिलस िवभाग के नाम आवंटन िकया जाने हेतु भूिम प्रबंधक सिमित के प्रस्ताव, अन्य वांिछत प्रमाण पत्र, अिभलेखों के साथ स्पष्ट आख्या चाही गई थी, िजसके अनुपालन में िदनांक 23.06.2025 को भूिम प्रबंधक सिमित का प्रस्ताव कर पुिलस चौकी िनमार्ण हेतु आख्या प्रेिषत जा चुकी है। प्रश्नगत भूिम पर आगरा किमश्नरेट के थाना ताजगंज के द्वारा उक्त भूिम पर बाउंड्री वाल करा दी गई है एवं एक कमरे का िनमार्ण भी िकया गया है। याची के गाटा संख्या 225 पर पहुंचने के िलए उक्त भूिम के पिश्चम िदशा की तरफ 10 फु ट का रास्ता छोड़ा गया है। याची के गाटा 225 पर पहुंचने के िलए दिक्षण िदशा की तरफ से एक रास्ता संख्या 265 राजस्व नक्शे में प्रदिशत है। अतः याची की गाटा संख्या में 226 में ग्राम सभा की बंजर भूिम से 20 फु ट चौड़े रास्ते की मांग िकया जाना अनुिचत है। याची की यािचका संख्या 19141 खािरज िकए जाने योग्य है।" 5. In view of the aforesaid instruction, we do not find any merit in the writ petition and accordingly, the same is dismissed with no order as to costs. 6.
