(Oral) CMP(M) No. 145 of 2025 As per the Office Report, respondent has been served. But none has put in appearance on his behalf, hence, he is proceeded against ex-parte. 2. The State has filed this application for condoning the delay of 350 days in filing the appeal 1 Whether the reporters of Local Papers may be allowed to see the judgment? 2 against the judgment dated 06.10.2023, passed by the learned Single Judge in CWP No. 7327 of 2023, Vinay Kumar Vs. State of H.P. & others. 2. Keeping in view the fact that similar matters are pending consideration, we deem it appropriate to condone the delay in filing the appeal since it will lead to granting contradictory relief in case the judgment of the learned Single Judge is sought to be implemented. Accordingly, the application is allowed and the delay in filing the appeal is condoned. The application stands disposed of. 3. Appeal is taken on Board. 4. The judgment under consideration places reliance upon earlier decision rendered in CWP 6611 of 2023, Surinder Singh Vs. State of Himachal Pradesh & Another, on 19.09.2023 and directed the State to decide the case in the light of the said case within four weeks. 5. In the judgment dated 22.08.2025, passed in LPA No. 109 of 2024, State of Himachal Pradesh & another versus Roshan Lal Khajuria & another,
3 we had noticed that the learned Single Judge had allowed the Review Petition No.25 of 2024, Surinder Singh’s case (supra) on 13.12.2024 and the writ petition was restored to its original number. The issue as raised is pending before the Co-ordinate Bench, since Clauses of both the Notifications dated 03.01.2022 and the Office Memorandum dated 25.02.2022, are subject matter of consideration. 6. Resultantly, we set aside the judgment of the learned Single Judge and restore the writ petition to its original number. 7.
The same be heard alongwith CWP No. 2108 of 2023, Bhagat Ram Vs. HRTC & others. 8. Accordingly, the appeal is disposed of. (G.S. Sandhawalia)
