Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. Petitioner by means of present writ petition has prayed for following relief: "1. Issue, a writ order or direction in the nature of mandamus commanding and directing respondents to immediately stop construction of the road on petitioner's bhumidhari land." 3. Sri Rajesh Kumar Pal, learned Standing Counsel, on instructions which are taken on record, states that no construction is being raised upon the plot of petitioner. Relevant extract of the instructions is being reproduced herein as under: "2. यह िक िनमार्णाधीन सड़क याची के भूिमधरी गाटा सं० 1011 की सीमा में िस्थत नहीं है। प्रचिलत रास्ता से गाटा सं० 1011 प्रभािवत नहीं है। रास्ता गाटा सं0 991 में चल रहा है। 4. भू-मानिचत्र के अवलोकन से यह स्पष्ट होता है िक प्रश्नगत रास्ता के मध्य का भाग लगभग 200 मीटर चकमागर् अथवा रास्ते के रूप में प्रदिशत नहीं है, जबिक मौके पर 4 मीटर से अिधक चौड़ा कच्चा मागर् आवागमन हेतु वषोर्ं से चल रहा है, उसी कच्चे मागर् को डामरयुक्त पक्का करने पर ग्राम बरहन तहसील एत्मादपुर की 10 मजरों की आबादी बरहन से जुड़ जायेगी। िनरीक्षण से यह स्पष्ट है िक रास्ता वषोर्ं पुराना है। उक्त रास्ते को डामरयुक्त बनाकर दोनों िकनारों पर बनी डामरयुक्त पक्की रोड से न जुड़ने से 10 मजरों का आवागमन प्रभािवत हो रहा है। याची द्वारा मात्र 200 मीटर रास्ते को पक्का िकये जाने में अवरोध उत्पन्न िकया जा रहा है। यह ग्रामीणों के बयानों से भी स्पष्ट होता है, संलग्नक-2 पठनीय है। Versus Counsel for Petitioner(s) : Mahesh Prasad Pandey, Vinay Kumar Pandey Counsel for Respondent(s) : C.S.C. Sunil Kumar .....Petitioner(s) State Of Uttar Pradesh And 5 Others .....Respondent(s) िवशेष कथन याची द्वारा यािचका में विणत यह कथन िक उसकी िनजी भूिमधरी गाटा सं0 1011 में बलपूवर्क सड़क का िनमार्ण कराया जा रहा है, असत्य व आधारहीन है। गाटा सं0 991 के कु छ भाग पर 40-50 वषोर्ं से प्रचलन में आ रहे कच्चे 200 मीटर रास्ते पर पक्का िनमार्ण कराना लोकिहत से जुड़ा है। इस प्रकार प्रश्नगत िरट यािचका लोकिहत के िवरुद्ध योिजत की गयी है। यिद याची को अपनी भूिमधरी गाटा सं0 1011 के रकवे में कमी की आशंका है तो उसे उ०प्र०रा० संिहता 2006 की धारा 24 अथवा अन्य सुसंगत धाराओं के अन्तगर्त उप िजलािधकारी न्यायालय में वाद योिजत कर अनुतोष प्राप्त करने का िवकल्प उपलब्ध है। याची प्रभािवत नहीं है। याची द्वारा प्रितफल की माँग अनुिचत है। याची द्वारा यािचका में िकये गये कथन असत्य, आधारहीन व िविधक रूप से बलहीन होने के कारण यािचका सव्यय िनरस्त होने योग्य है। तहसीलदार एत्मादपुर उप िजलािधकारी एत्मादपुर, आगरा िजलािधकारी आगरा।" 4. Since it has come in the instructions that the construction is not being raised over the plot in question, therefore, the question as to whether the construction is being raised over the plot of the petitioner or not is a disputed question of fact which can be determined only on the basis of pleadings and evidence on record and this Court cannot settle the aforesaid issue in exercise of power under Article 226 of the Constitution of India. 5.
