Learned counsel for the petitioner argues that the petitioner is entitled for the benefit of the higher pension keeping in view the judgment of the Hon’ble Supreme Court of India in R.C. Gupta and others Vs. Regional Provident Fund Commissioner, Employees Provident Fund Organisation and others, (2018) 14 SCC 809, which benefit is not being granted to the petitioner and that too without any valid justification though the law on the said issue has already been settled. 2. Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the representation dated 20.05.2025 (Annexure P-12) but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.
