Taking into consideration the fact that the respondent-husband has filed M.C.No.65/2023 before the Principal Judge, Family Court, Raichur (for short “the Family Court”) under Section 13 of the Hindu Marriage Act, where the petitioner-wife has stated that it is difficult for the petitioner to attend the proceedings before the Family Court at Raichur and sought for transfer of the said case to the competent Family Court at Bhatkal. 4. Taking into consideration the distance between Bhatkal and Raichur is more than 500 km and that the petitioner herein has to take care of her three daughters, I am of the view that the petition is liable to be allowed. Accordingly, the petition is allowed. 5. That the M.C.No.65/2023 pending on the file of the Principal Judge, Family Court, Raichur, is withdrawn and - 3 - NC: 2025:KHC-D:3418 CP No. 100164 of 2024 transferred to the Court of Senior Civil Judge, Bhatkal, forthwith. 6. In view of disposal of the petition, pending interlocutory applications, if any, do not survive for consideration and are disposed of accordingly.
