The allegations against the petitioner are, indeed, very serious as would appear from the FIR and the statements of witnesses including the victim. However, more importantly, a prima facie case is made out under the provisions of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. As such, the application for anticipatory bail is not maintainable. In view of the above, the application for anticipatory bail is dismissed as not maintainable.
