Applicant is in judicial custody in FIR No.471 of 2023, under Sections 304 & 377 IPC, Police Station Jaspur, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

It is argued by learned counsel for the applicant that insofar as under Section 304 IPC is concerned, the role of the applicant is similar to that of co-accused who has already been granted bail. It is submitted that the only addition is offence under Section 377 IPC.

Learned State Counsel would submit that insofar as the offence under Section 304 IPC is concerned, the role of the applicant is similar to that of
2 the co-accused who has been granted bail. But, she would submit that there are allegations for the offence under Section 377 IPC also against the applicant.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
