JUSTICE PRAVEER BHATNAGAR Order 13/02/2025 The instant bail application has been filed under Section 483 of BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 11/2025 registered at Police Station Batoda, District Sawai Madhopur for the offence under Sections 319(2) and 318(4) of BNS and Section 13 of RPGO and Sections 66C and 66D of IT Act. Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioner are exclusively triable by Magistrate. The accused- petitioner is in custody since long and the trial of the case may take considerable time furthermore there are no criminal antecedents against the petitioner, therefore, the petitioner may be enlarged on bail. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioner is triable by Magistrate. The accused-petitioner is in custody since long and the trial of the case may take considerable time, furthermore there are no criminal antecedents against the petitioner, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Puranmal S/o Prabhulal, in connection with FIR No. 11/2025 registered at Police Station Batoda, District Sawai Madhopur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
