CRM-M-63488-2025 (O&M) -1- IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 232 CRM-M-63488-2025 (O&M) Date of decision:21.01.2026 Prabhinder Singh ... Petitioner Vs. State of Punjab ... Respondent
CORAM:
HON'BLE MRS. JUSTICE MANISHA BATRA Present: Mr. Rajesh Bhatheja, Advocate for the petitioner. Ms. Sakshi Bakshi, AAG, Punjab. ... Manisha Batra, J. (Oral). 1. The instant petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) for grant of regular bail in case arising out of FIR No.162, dated 24.06.2025 registered under Sections 109, 351(2), 126(2), 3(5), 61(2), 238 of the BNS and Sections 25/27 of the Arms Act, at Police Station City South, Moga, District Moga. 2. As per the allegations, on 23.06.2025, the complainant – Asha Rani w/o Rajesh Kumar was sitting in front of his house along with his parents, when the accused Gurmanpreet Singh @ Babal and Sahil Kumar @ Batua accompanied by the present petitioner reached there on a motorbike. Accused Sahil Kumar @ Batua was holding a pistol and fired a shot with the same upon the complainant with an intention to kill him and thereby hitting HARJEET KAUR 2026.01.22 10:41 I attest to the accuracy and integrity of this document

The above said Sahil Kumar @ Batua started firing shots upon the complainant, thereby injuring his left thigh and left leg. On clamour being raised, family members of the victim reached there and then the assailants had fled from the spot along with their bike and weapon. After registration of the FIR, investigation proceedings were initiated. The petitioner was arrested on 30.06.2025. Co- accused were subsequently arrested. Investigation now stands completed. 3. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. No injury whatsoever on the person of the complainant has been attributed to him. He is in custody since long. He is not required for further investigation. He has clean antecedents. No fruitful purpose would be served by detaining him in custody anymore. There are no chances of conclusion of the trial in near future. Accused Gurmandeep Singh, whose case is on similar footing, has been extended benefit of bail by the learned trial Court. On parity, he too deserves to be extended the same benefit. It is, therefore, urged that the petitioner deserves to be released on bail. 4. Status report and custody certificate have been filed.
It is argued by learned State counsel that keeping in view the gravity of the allegations as levelled against the petitioner, he does not deserve to be extended the benefit of bail. 5. This Court has heard the rival submissions made by learned counsel for the parties. 6. The petitioner accompanied by the co-accused, is alleged to have opened an attack upon the complainant as on 23.06.2025. He was one HARJEET KAUR 2026.01.22 10:41 I attest to the accuracy and integrity of this document

As per the prosecution version itself, the shot was fired at upon the complainant by the Sahil Kumar @ Batua. Investigation now stands completed. The trial will obviously take time to conclude. No fruitful purpose would be served by keeping the petitioner in custody. Taking into
consideration the above discussed facts and circumstances, the period spent by the petitioner in custody and his clean antecedents, but without meaning to make any comment on the merits of the case, this court is of the considered opinion that the petitioner deserves to be extended benefit of bail. Accordingly, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds to the satisfaction of the learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
7. Since the main petition has been allowed, pending application, if any, is rendered infructuous.
