1. Heard.
2. The petitioners are facing prosecution in connection with Bargarh Town P.S. Case No.130 of 2010 corresponding to G.R. Case No.362 of 2010 pending in the Court of the learned SDJM, Bargarh.
3. The petitioners are aggrieved by the order dated 28.03.2024 whereby the learned SDJM, Bargarh issued NBW in G.R. Case No. 362 of 2010 as because the petitioners have been consistently remaining absent in the court proceeding.

Learned counsel for the petitioners on instruction from his clients undertakes that his clients would be appearing before the
Court below on or before 25.01.2025 and seek appropriate remedy available to them under law.
5. Taking into consideration the above facts and submission at the Bar, the order dated 28.03.2024 passed by the learned SDJM, Bargarh in connection with Bargarh Town P.S. Case No.130 of 2010 corresponding to G.R. Case No.362 of 2010 is set aside, subject to the petitioners appearing/surrendering before the Court below on or before 25.01.2025 and paying cost of Rs.1000/- to be deposited in the Advocates’ Welfare Fund of Bargarh District Bar Association.
6. The CRLMC is disposed of.
