Learned counsel appearing for the petitioner submits that the present writ petition is against an order dated 19.12.2024, passed by the learned Chief Judicial Magistrate, Srinagar, for attaching the property of the petitioner. He further submits that he had filed a writ petition wherein he had challenged the notices issued to him under Section 13 (2) of the SARFAESI Act and the Court had directed that the representation filed by the petitioner be considered by the Bank.
However, in the present case while the representation is still pending under consideration, the order dated 19.12.2024 was passed by the learned Chief Judicial Magistrate, Srinagar.
Learned counsel appearing for the Bank very fairly submits that on the basis of the instructions received by her, that till the representation of the petitioner is decided, the Bank will not take further action pursuant to the order passed by the learned Chief Judicial Magistrate, Srinagar. She further informs that the Receiver has been Arif Hameed I attest to the accuracy and authenticity of this document 13.03.2025
informed by the Bank not to take further action till further instructions from the Bank.
Under the circumstances, making the said statements made by the learned counsel appearing for the Bank as order of the Court, the petition is disposed of.
