The petitioner claims to be bhumidhar having ¼ share in Arazi No.862/2 measuring 1.265 hectare. According to the petitioner, the Forest Department is illegally taking possession of the land of the petitioner under garb of taking possession of forest land. The petitioner is stated to have filed an application before Sub Divisional Magistrate, Sadar, Mirzapur for amendment in the map. According to the petitioner, no action has been taken by Sub Divisional Magistrate, Sadar, Mirzapur on the said application while on the other hand there is eminent threat of the petitioner being dispossessed by the respondents. 2. Ms. Kirtika Singh, learned Additional Chief Standing Counsel submits that grievance of the petitioner can be redressed in case his holding is demarcated. 3. We find considerable force in the submission of learned Additional Chief Standing Counsel. 4. Accordingly, without expressing any opinion on merits, the writ petition is disposed of with direction to respondent No.5 to demarcate the holding of the petitioner within six weeks from the date of communication of the instant order along with a proper application for demarcation and for correction of the map, if any correction is required in the same.
