This revision is directed against the judgment and order dated 23.12.2024 passed by learned Additional Chief Judicial Magistrate, Rishikesh, District Dehradun, in Criminal Case No.686 of 2024 State Vs. Ajeet and Ors., (Case Crime No.252 of 2024), under Sections 420, 468 and 120-B IPC, whereby, the learned Trial Court has rejected the application filed by the revisionist for releasing the vehicle being registration No. DL 3CCW 5412. 4. From perusal of the record, it transpires that instead of filing the revision against the said order before the learned Sessions Judge/Additional Sessions Judge of Competent Jurisdiction, revisionist has filed present revision petition straightway before this Court. 5. It is true that the High Court and the Sessions Court got plenary and parallel power for entertaining the revision petition, but, still it is left to the discretion of the Court to entertain such revision petition or not. This Court doesn’t want to use its discretionary power to hear the present revision. 2025:UHC:5683 6. Accordingly, the present revision is dismissed. However, a liberty is given to revisionist to move a revision petition before the learned Sessions Judge/ Additional Sessions Judge of the Competent Jurisdiction. Learned Revisional Court shall consider the application of the revisionist for condoning the delay in revision sympathetically. 7. Pending application, if any, also stands disposed of.
