The petitioner has preferred this application for grant of regular bail in connection with Kursela P.S. Case No. 19 of 2025 dated 19.01.2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 109, 352 and 351(2) of the B.N.S. and Section 27 of the Arms Act. 3. As per the prosecution case, the informant alleged that two gangs are shot firing upon each other for dominance and to grab the land of diyara. On information, police reached at the place of occurrence, on seeing police, the accused persons of both gang started fleeing away. Thereafter, the villagers told that the gangs of Vipin Yadav and the gangs of Rupesh Yadav were

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. There is no specific allegation of firing against the petitioner rather the allegation against the petitioner is general and omnibus in nature. It is further submitted that from perusal of the FIR, it appears that one Vipin Yadav and Rupesh Yadav are the leader of their gangs who always used to shot firing upon each other to grab the land of diyara. It is further submitted that in the alleged firing, committed by both the sides, no one sustained any injury. The petitioner has no concern with the alleged occurrence. The petitioner has five criminal antecedents in which he is on bail in all cases as stated in para 3 of the bail petition. The petitioner is in custody since 17.05.2025. 5.
Learned A.P.P. for the State has opposed the bail petition of the petitioner. 6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
