Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the recovery of contraband article was effected from the possession of other co-accused namely: Sanjay Kumar, Omprakash, Vijay Nagar, Momraj and Chandraprakash, who have already been enlarged on bail by this Court vide order dated 24.01.2025. It is also contended that no recovery was effected at the instance of the present petitioner. It is alleged against the accused-petitioner that he supplied the contraband
[2025:RJ-JP:8273] (2 of 3) [CRLMB-2020/2025] articles containing weight of 1 Kg 13 grams of opium to the other co-accused and also received amount through Pay wallet. The accused-petitioner is in custody since long and charge-sheet has already been produced before the concerned Court, there are no criminal antecedents against the accused-petitioner, the trial of the case may take considerable time, therefore, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioner has supplied contraband articles to the other co-accused and it was revealed that the accused-petitioner received amount from the other co-accused Sanjay Kumar and Chandraprakash in his Pay wallet, therefore, considering the above facts, the bail application of accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case. Considering the fact that the recovered quantity of contraband articles from the possession of the other co-accused is below commercial quantity. The other co-accused have already been enlarged on bail and there are no criminal antecedents against the accused-petitioner, the trial of the case may take considerable time and the accused-petitioner is in custody since long and charge-sheet has already been produced before the concerned Court, therefore, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Gopal Singh
