Counsel for Applicant :- M J Akhtar,Shahzad Alam Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. Heard Sri V.M. Zaidi, learned Senior Counsel assisted by Sri M.J. Akhtar, learned counsel for the applicant; learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Vipin, with a prayer to release him on bail in Case Crime No. 220 of 2023, under Sections 366, 302, 376, 377 IPC, Police Station Meerapur, District- Muzaffar Nagar, during pendency of trial. There are allegations in the FIR against the applicant that he abducted 20 years old daughter of the informant despite being married and having two children. FIR was lodged on the basis of suspicion. Learned Senior Counsel for the applicant has submitted that FIR was lodged after 12 hours of the incident on 16.10.2023. The dead body of the deceased was recovered from alto car on 18.10.2023. Thereafter it was discovered by the Investigating Officer that deceased eloped with the applicant and went to Prayagraj for solemnization of marriage with the applicant. They stayed at Kashyap lodge, Civil Lines, Prayagraj from 7:00 p.m. on 16.10.2023 to 6:20 on 17.10.2023. Thereafter applicant was arrested and confession was recorded. Leaned Senior counsel for the applicant has submitted that goods recovered from the car was planted. He has submitted that deceased was working in the bangle shop of the wife of the applicant earlier, but she was removed from job by his wife six months ago because of unsatisfactory work. Hence applicant has falsely been implicated in this case. Learned AGA has vehemently opposed the prayer for bail of the applicant. This Court, after hearing the learned counsels for the parties, does not finds any ground for enlarging the applicant on bail at this stage. The bail application is, accordingly, rejected. The trial court is directed to conclude the trial against the applicant, as expeditiously as possible, as per Section 346 B.N.S.S./309 Cr.P.C.
