By this petition, the petitioner seeks direction to the respondent MIDC Authority to allot Plot No. X – 2 in the Kalamnuri Industrial Area to the petitioner. 2. The said request of the petitioner is turned down by the respondent Corporation by order dated 17.03.2016. This order is also impugned in the present petition. 3. Having heard learned advocate for the petitioner and learned advocate for respondent MIDC Corporation, and considering the fact that the petitioner has no vested legal right to claim allotment of the said plot, and further in view of the prevailing policy of the Corporation to komal kamble 1/2 2025:BHC-AUG:32705-DB 949 WRIT PETITION NO. 2082 OF 2017 auction commercial plots as per Maharashtra Industrial Land Application & Allocation Policy (MILAAP), we find no merit in the present petition and the same is, therefore, disposed of. 4. We, however, make it clear that Corporation may auction the said plot as per their policy, if it is still not allotted, and the petitioner will be entitled to participate in the said process.
