Neutral Citation No. - 2025:AHC:103320-DB Court No. - 40 Case :- WRIT - C No. - 20561 of 2025 Petitioner :- Ramdas And Another Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Dr. Kamlesh Kumar,Rakesh Kumar Counsel for Respondent :- C.S.C.,Gautam Dubey Hon'ble Ashwani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioners and Sri Harsh Vardhan Gupta, learned counsel for respondents. Prayer made in the writ petition is to command the respondent nos.2 and 3 to decide the petitioners' representation dated
9.5.2025. The other prayer in the writ petition is to restrain the respondent nos.4 to 6 from interfering in the peaceful possession of the petitioner over the house in question. Perusal of the materials placed on record as also the representation would reveal that there is a dispute relating to immovable property between petitioners and respondent no.7. The allegation in the writ is that at the instance of respondent no.7 respondent nos. 4 to 6 are interfering over the petitioners' possession. Respondent nos.4 to 6 are the officials of Nagar Nigam. In the facts of the case, it appears that the private dispute between the petitioners and private respondent no.7 is sought to be agitated in the present writ petition and the prayer has been made only with an intent to facilitate such adjudication. We are of the view that private dispute in respect of immovable property can only be resolved by the competent civil court. No interference in the writ petition is warranted, which is, accordingly, consigned to records. Order Date :- 3.7.2025 RA Digitally signed by :- RAZIQ ALI High Court of Judicature at Allahabad
