Ajay Mohan Goel, Judge (Oral) The Court stands informed that respondent No.1 is dead. 2. In light of the above, the name of respondent No.1 is deleted for the purpose of the adjudication of this petition only. 3. The petitioner had approached this Court against the order passed by the learned Tribunal in an application preferred by the respondents herein alongwith the main suit and Order 39 Rule 1 and 2 of the Civil Procedure Code as well as the judgment passed by the learned Appellate Court in an appeal preferred by 2 the present petitioner, which was dismissed. This petition was filed in the year 2016 and the operation of the order and judgment under challenge was not stayed by this Court. 4. In the light of this fact, as obviously, this petition has lost its efficacy now these proceedings are closed without adjudication on merit, but with the observation that the learned Trail Court will make an endeavor to decide the Civil Suit as expeditiously as possible.
