Neutral Citation No. - 2025:AHC:111310-DB Court No. - 21 Case :- WRIT - C No. - 18593 of 2025 Petitioner :- Chunni Lal Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Ajay Kumar Pandey,Jaideep Tripathi Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J. 1. The following prayers have been made in the writ petition: "I- Issue a writ, order or direction in the nature of certiorari quashing the recommendation dated 15-05-2025 submitted by respondent no. 4 passed by way of which a recommendation has been passed to reject the petitioner's claim for granting compensation under **eq[; ea=h d`"kd nq?kZVuk dY;k.k ;kstuk**, with all its consequential effects. II- Issue a writ, order or direction in the nature of mandamus commanding the respondents (Specially the respondent no. 2) to ensure payment of compensation in favour of the petitioner by considering her eligibility of **eq[; ea=h d`"kd nq?kZVuk dY;k.k ;kstuk**, within stipulated period of time." 2. The petitioner has applied for compensation under **eq[; ea=h d`"kd nq?kZVuk dY;k.k ;kstuk**, on account of death of his son Satyajeet on 27.07.2024 as a result of electrocution. There is a adverse report against him by the tehsil authorities and apparently for the said reason, the claim has not been allowed so far. The petitioner has prayed for a writ of certiorari seeking quashing of the recommendation dated 15.05.2025 and for a further direction to respondent No. 2 to pay compensation to the petitioner. 3. Learned standing counsel submits that in case the petitioner is disputing the correctness of the recommendation made by the tehsil authorities, it is open to him to file his objection against the same before respondent No. 2 so that the same may be considered while deciding the claim. 4. Accordingly, we dispose of the instant petition with liberty to the petitioner to file his objection against the recommendation of the tehsil authorities dated 15.05.2025 within three weeks before respondent No. 2 along with true attested copy of the instant order and in which event, respondent No. 2 will examine the same and also provide opportunity of hearing to the petitioner before taking decision in the matter. The entire exercise in this regard shall be concluded within twelve weeks from the date of communication of the instant order. Order Date :- 11.7.2025 Mukesh Kr. (Ram Manohar Narayan Mishra,J.)
