Heard learned counsel for the applicant, learned Additional Government Advocate for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 125 of 2025, under Section 2/3 of U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986, police station Nagal, district Saharanpur during the pendency of trial. On the matter being taken up, learned A.G.A. representing the State pointed out that apart from one case being Case Crime No. 10 of 2025, under Sections 3/5/8 of Cow Slaughter Act, police station Nagal, district Saharanpur against the applicant shown in the gang chart, the applicant has criminal history of one another case being Case Crime No. 0112 of 2019, under Sections 3/5/8 of Uttar Pradesh Prevention of Cow Slaughter Act and Section 11 of Prevention of Cruelty to Animals Act, 1960 whereas the applicant instead of explaining the aforesaid Case Crime No. 0112 of 2019 has filed an order dated 11.09.2021 passed in Case Crime No. 112 of 2018, under Sections 138-1-B of Electricity Act in the matter of Rajkishore Vs. Devendra Kumar. In response, learned counsel for the applicant could not give satisfactory reply and submits that he may be allowed to withdraw this bail application with liberty to file fresh bail application with better particulars. Learned A.G.A. representing the State has no objection to such prayer of learned counsel for the applicant. In view of the above, instant bail application is dismissed as withdrawn/not-pressed with liberty as prayed for. Office is directed to return certified copy of the documents, if any, after retaining the xerox copy of the same, to learned counsel for the applicant within three days.
