AD 20 December 23, 2025 Ct. 28 ssi CRM(A) 4003 of 2025 An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Anandapur P.S. Case No.117 of 2025 dated 30.05.2025 under Sections 103(1)/238/3(5) of the BNS, 2023. And In the matter of: Susil Bardolai @ Sushil Bardolai @ Toton Bardolai … petitioner Mr. Navanil De Mr. Shoumilya Mazumder … for the petitioner Ms. Faria Hossain, Ld. APP Mr. Sandip Chakraborty Ms. Ayana Dey … for the State Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The victim had an illicit affair with a lady. They were caught red handed. The victim was assaulted by the mob. Learned counsel for the State strongly opposes the prayer for anticipatory bail. She relies on the post-mortem report which shows infliction of several injuries on the body of the victim. She also relies on the statements of the witnesses and submits that the victim was accosted by the petitioner and taken to a ‘salisi sabha’. There he was brutalised and was confined for two days. He was assaulted by the petitioner time and time again until he succumbed to this injuries. The accused attempted to conceal the dead 2 body in the river-bed, from where it was subsequently recovered. It appears that an application for anticipatory bail of a similarly circumstanced co-accused was rejected by this Court on 05.12.2025 in CRM (A) 3919 of 2025. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
