Ranjan Sharma, Judge [Oral] Petitioner [Satpal], a Shastri Teacher presently serving in GMS Larji, District Kullu [HP], has come up before this Court seeking the following relief: i) That any appropriate writ/order or direction may kindly be issued and the Respondents may kindly be directed to transfer the petitioner from present place of posting i.e. Government Middle School Larji U/C GSSS Manglore Distt Kullu H.P to Government Middle School Baadi Block Sundernager , Government High School Janjhar U/C Government Sr. Sec. School Sayanj Block Chachyot-l District Mandi HP. in view of the 5% 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes 2025:HHC:3043 Inter District Transfer Policy which has been framed by the Govt.Of H.P. ii) That any appropriate writ/order or direction may kindly be issued and the Respondents may be directed to consider the case of the petitioner under 5% Inter District Transfer Policy on priority basis, or any other station suitable to the petitioner any of the vacant post nearby native place of the petitioner. 2. Case of the petitioner as set up by Learned Counsel is that the petitioner had made a representation seeking consideration of her case for Inter District Transfer from GMS Larji, u/c to GSSS Manglore, District Kullu H.P. to GMS, Baadi, Block Sundernagar, GHS, Janjhar u/c GSSS Sayanj, Block Chachyot-I, District Mandi [HP] or any other vacant post nearby Mandi on the ground that the petitioner has already completed her normal tenure of five years at the present place of posting. 3. 3. Learned Counsel for the Petitioner on instructions states that the petitioner shall be satisfied in case the Respondent No.2-Director of Elementary Education, Shimla, Himachal Pradesh is directed to examine the representation in view of Inter District Transfer Policy 2025:HHC:3043 dated 20.11.2021 (Annexure P-2) by transferring the petitioner from GMS Larji, u/c to GSSS Manglore, District Kullu H.P. to GMS, Baadi, Block Sundernagar, GHS, Janjhar u/c GSSS Sayanj, Block Chachyot-I, District Mandi [HP], as requested in representation dated 19.12.2024 [Annexure P-4] expeditiously. 4. Prayer made by the Learned Counsel for the Petitioner being innocuous is not opposed by the Learned State Counsel who asserts that the claim of the petitioner shall be considered by the Respondents in view of the existing Inter District Transfer Policy dated 20.11.2021 [Annexure P-2] in accordance with law. 5. Taking into account the entirety of the facts and circumstances, this Court disposes of the instant petition, in the following terms : (i) State Authorities-Respondent No.2- Director of Elementary Education, Shimla, Himachal Pradesh is directed to examine the representation(s) dated 19.12.2024 [Annexure P-4] in terms of existing Inter District Transfer Policy dated 20.11.2021 [Annexure P-2] in accordance with law on or before 28th February, 2025; (ii). Respondents - State Authorities are directed to afford a personal hearing to the petitioner before deciding the representation as a sequel to direction No (i) above; 2025:HHC:3043 (iii). No order as to costs. 6. Needless to say that this Court had not adverted to the merits of the case and all questions are left open.
