The appeal has been preferred:- “against the order dated 10.01.2023 and 18.03.2024 passed by learned 1st Addl. Sessions Judge cum Special Judge SC/ST Act, Motihari, East Champaran in Motihari SC/ST P.S. Case No. Patna High Court CR. APP (SJ) No.3621 of 2024(4) dt.24-02-2025 2/2 12/2021, Tr. No. 11/23, CIS 107/21 whereby and whereunder while on 10.01.2023 the learned Special Court has taken cognizance for the offences u/s 341, 323, 504, 506, 34 I.P.C. and Section 3 (1) (a) (r) (s), 3 (2) (va) of SC/ST Act against the appellants and thereafter on 18.03.2024 the learned Special Court has framed charges against the appellants u/s 341, 323, 504, 506, 34 of I.P.C. and Section 3 (i) (r) (s) and 3 (2) (va) of SC/ST Act without considering the fact that no case under any penal section including SC/ST Act is made out against the appellants.” 3. After some arguments, learned Senior Counsel for the appellant prays for withdrawal of the present petition to approach the concerned Court with appropriate pleadings. 4. Granting liberty, the Cr.
