Order on Board 30/01/2025 Heard.
1. By the present writ petition, the petitioners, who are the villagers of Gram Panchayat Ranka, District Bemetara, are seeking a limited prayer that though they have lodged complaint against Sarpanch of the village Ranka (respondent No. 5) alleging serious financial irregularities, the respondent authorities are not taking proper action on the complaint lodged by the petitioners.
2. Learned counsel for the petitioner would submit that petitioners have lodged complaint in the month of May, 2024 on the basis of which Chief Executive Officer, Janpad Panchyat by its communication dated 23.08.2024 has asked Secretary, Gram
3 Panchayat, Ranka to submit enquiry report about the alleged irregularities committed by the Sarpanch (respondent No. 5). He further submits that the petitioners have submitted a reminder dated 27.09.2024 to the Collector, Bemetara. He further submits that CEO, Zila Panchyat Bemetara has issued memo dated 08.10.2024 instructing Chief Executive Officer, Janpad Panchayat, Berla to conclude the proceedings within stipulated time as
directed by the Collector. He further submits that inspite the same, till date no final order has been passed and no action has been taken against the Sarpanch (respondent No. 5).
3. Learned State counsel submits that it appears from the pleadings and documents placed by the petitioners that on the direction of the District Collector, the CEO, Zila Panchayat and Janpad Panchayat have taken steps for enquiry against the Sarpanch in pursuance of the complaint lodged by the petitioners, but till date if no action has been taken on the complaint, the same will be considered and decided within stipulated time period in accordance with law.
4. I have heard learned counsel for the parties and perused the documents placed.
5. Perusal of the documents annexed would show that on the complaint lodged by the petitioners despite directions from the Collector and CEO, Zila Panchayat to submit the enquiry report along with opinion the CEO, Janpad Panchayat has not taken any
4 initiative in respect of the same.
6. Considering the above facts and circumstances, it is directed that as the complaint has been lodged in the month of May, 2024 and subsequent reminder has also been made to the Collector on 27.09.2024, it is directed that Collector, Bemetara shall look into the complaint lodged by the petitioners and take necessary steps and action in accordance with law by providing proper opportunity of hearing to all the parties including respondent No. 5 (Sarpanch) within a period of 50 days from the date of receipt of a copy of this
order.
7. With the aforesaid observation, the petition stands disposed off. Sd/-
