The petitioner named above has been made accused in connection with Chiniya P.S. Case No. 17 of 2022 (G.R. No. 188 of 2023) for the offence registered under Sections 385, 387 and 506/34 of the Indian Penal Code and Section 17 of C.L.A. Act, pending in the court of Judicial Magistrate, 1st Class, Garhwa. Earlier the prayer for bail of this petitioner was rejected by this Court on merit vide order dated 11.07.2023 passed in B.A. No. 5193 of 2023. Prayer for bail of the petitioner is being renewed on the ground that the petitioner has remained in custody since 07.10.2022. It is submitted that all the sections are triable by Magistrate and the petitioner is in custody for two years and five months and till date, out of 13 witnesses, four have been examined. Learned counsel for the State has opposed the prayer for bail. Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
