Present applicant–Pravesh S/o Shri Radheyshyam is seeking bail in relation to FIR No.0450 of 2025, registered on the basis of FIR dated 24.04.2025 at Police Station Laksar, District Haridwar, wherein the present applicant has been implicated for the offence punishable under Section 8/22 of the NDPS Act. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated and, in fact, he is having the license to run the medical store and the prohibited drug, as shown to be recovered from the present applicant, is below commercial quantity, and, furthermore, there is no proper compliance of the mandatory provision of the NDPS Act and the applicant has no previous criminal history. 5. Apart from this, learned counsel for the applicant submits that the wife of the present applicant is 08 months’ pregnant and there is no one to look after her. 6. On the other side, learned State counsel have not disputed this fact that the prohibited drug, which was shown to be recovered from the possession of the present applicant, is below commercial quantity, and, furthermore, the applicant has no previous criminal history. 2025:UHC:3934 7. After hearing the arguments as advanced by learned counsel for the parties and further taking into consideration that the prohibited drug, which was shown to be recovered from the possession of the present applicant, is below commercial quantity and the applicant has no previous criminal history, this Court is of the view that the applicant deserves to be enlarged on bail. 8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 9. Let the applicant, namely, Pravesh, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
