And In the matter of: Sajamal Jamader ….Applicant/Petitioner Mr. Kalyan Kumar Bhattacharjee Ms. Aasia Khatoon …for the petitioner Mr. Aniket Mitra Ms. Ankita Paul ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. There are case and counter case. Both side received injuries. The petitioner has been falsely implicated in this case. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary and points to the statements of the victim and other witnesses and to the injury reports. The victim suffered grievous injury. His fourth toe had to be amputated. As per the statements of the victim, the petitioner assaulted him with a “katari”. This allegation is supported by two independent eye-witnesses. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected. (Jay Sengupta, J.)
