Affidavit-in-opposition filed by the opposite party be taken on record. The present petition has been filed for transfer of Matrimonial Suit No. 221 of 2023 from the Court of learned District Judge, Birbhum at Suri to any competent Court at Paschim Medinipur. The transfer has been sought on the ground that the petitioner/wife is residing in the jurisdiction of Chandrakona Police Station, Paschim Medinipur and it would be inconvenient for her to travel to Birbhum as she is physically handicapped.
Learned counsel for the opposite party has opposed the transfer.
2 The plea of the opposite party is that the husband is an Associate Professor in a Government College at Birbhum and it would be inconvenient for him to travel to Paschim Medinipur. Learned counsel also submits that this would also require him taking leave, which will not be in overall interest of his students. During the course of submissions, both the parties have agreed that the Matrimonial Suit No. 221 of 2023 may be transferred to the competent Court under learned District and Sessions Judge, Purba Bardhaman as this would be mutually convenient to both and will also balance their interest. In view of the submissions, the Matrimonial Suit No. 221 of 2023 is withdrawn from the Court of learned District Judge, Birbhum and assigned to the learned District and Sessions Judge, Purba Bardhaman. Learned District and Sessions Judge, Purba Bardhaman may assign the same to the competent Court of jurisdiction. The concerned Court, in view of the medical condition of the petitioner as stated on record, shall grant permanent exemption to the petitioner and may order for personal appearance only if it is required under law. The application being CO 2154 of 2024 stands
disposed of.
3 Copy of the order be served to the transferee Court. The Transferrer Court is directed to send the record to the Transferee Court.
