The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No.2-Amritsar Improvement Trust to address his representation dated 16.05.2024 (Annexure P-4) followed by legal notice dated 01.04.2025 (Annexure P-5) in a time bound manner.

The petitioner claims that he is owner of land measuring 312.5 sq.yds. falling in Khasra No.3769/1145 min (original Khasra No.1145/3 min), village Sultanwind Sub-Urban, Amritsar. Respondent No.2-Amritsar Improvement Trust published a notification in December’ 1994 inviting objections with respect to its 340 acres Development Scheme under Section MOHIT KUMAR 2025.06.03 09:15 I attest to the accuracy and integrity of this

-2- 36 of Punjab Town Improvement Act, 1922. The respondent vide notification dated 24.07.1995 exempted constructed buildings after collecting exemption fee and development charges. The respondent on 30.03.2000 and 20.12.2000 withdrew its decision to grant exemption. This Court vide judgment dated 25.02.2002 in CWP No.2077 of 2001 set side aforesaid resolution. The respondent issued NOC with respect to properties adjoining the property in question. The petitioner vide representation dated 16.05.2024 has requested the respondent to issue necessary NOC to get the building plan sanctioned from Municipal Corporation, Amritsar. He has also sent reminders followed by legal notice dated 01.04.2025 but to no avail.

Ms. Samdisha Kaur, Assistant Advocate General, Punjab and Mr. Abhilaksh Gaind, Advocate, who on advance notice are present in Court, accept notice on behalf of respondent No.1 and respondent Nos.2 & 3, respectively.

On the request of both sides, the matter is taken up for final adjudication.

Learned State counsel submits that representation of the petitioner has to be decided by respondent Nos.2 and 3.

Learned counsel for respondent Nos.2 and 3 assures the Court that competent authority would decide petitioner’s representation dated 16.05.2024 (Annexure P-4) and legal notice dated 01.04.2025 (Annexure P-5) within three months from today.
