By the present writ petition, the petitioner is questioning the order of transfer of the petitioner from the post of In-charge Block Education Officer, Pendra District: Gaurella-Pendra-Marwahi to Gurukul Higher Secondary School Pendra Road, Block Gaurella, District: Gaurela-Pendra-Marwahi, C.G. 2. Learned counsel for the petitioner submits that initially one Vijay Kumar Verma was posted as In-charge, B.E.O., he was not inclined to join as a In-charge, B.E.O., and the said Vijay Kumar Verma questioned his posting by writ petition bearing WPS No.1588/2025, which was allowed and he was directed to work as Principal at Swami Atmanand Higher Secondary School, Pendra, District:Gaurella-Pendra-Marwahi, in between, the respondent No.7 who is a Lecturer and junior to the petitioner has been posted in place of the petitioner by the order of District Education Officer and hence, the order impugned by which the petitioner has been transferred from the present place of posting and placing the junior Lecturer on his place, is not just and proper. 3. Learned counsel for the State and counsel for respondent No.7 submit that subsequently, the order of posting of the respondent No.7 as a In-charge, B.E.O. has been cancelled by order dated 06/02/2025 by the Collector-cum-District Election Officer, District, Gaurella-Pendra-Marwahi. Learned counsel for the State submits that as the posting of respondent No.7 has already been cancelled, but still there is an interim order continuing in favour of 3 / 3 the petitioner vide order dated 27/02/2025. He further submits that as presently, no one is posted in the present place of posting of the petitioner i.e. In-charge, Block Education Officer, Pendra District: Gaurella-Pendra-Marwahi and a committee has been constituted on 03.03.2025 and if the petitioner will approach the committee, said committee shall consider the grievance of the petitioner in accordance with the policy of the State Government and grievance if any raised by the petitioner, the same shall be redressed within a stipulated period. 4. I have heard learned counsel for the parties and perused the pleadings and the documents. 5. In view of submission made by learned counsel for the State, the writ petition is disposed of with a direction to the petitioner to approach the Committee constituted by the State Government and submit a representation within a period of 20 days. If the petitioner will file any such representation before the committee, the committee is directed to consider the same and pass necessary order in accordance with the policy of the State Government by considering the grievance of the petitioner within a further period of 25 days. Till then, the interim order dated 27/02/2025 passed by this Court shall remain operative. 6. With the aforesaid liberty and direction, the writ petition is disposed of.
