[2025:RJ-JP:20340] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 2380/2024 Ram Lal S/o Shri Basti Ram, Aged About 23 Years, R/o Kachi Basti, Lohar Colani, Sojat City, Tehsil Sojat City, District Pali, Rajasthan. ----Petitioner Versus
1. Rajasthan Public Service Commission, Ajmer, Through Its Secretary, Jaipur Road, Ghooghara Ghati, Ajmer, Rajasthan.
2. Director General of Police, Recruitment And Promotion Board, Police Head Quarter, Lal Kothi, Jaipur, Rajasthan. ----Respondents For Petitioner(s) : Mr. Raghu Nandan Sharma For Respondent(s) : Mr. Samee Khan Ms. Devakriti Vashishtha for Mr. Bhuwnesh Sharma, AAG Mr. Yuvraj Samant Ms. Neha Amola Mr. Tilak Vaid HON'BLE MR. JUSTICE SUDESH BANSAL Order 14/05/2025
1. With consent of counsel for both the parties, the writ petition has been heard finally at this stage.
2. Petitioner applied and participated in the direct recruitment- 2021 for the post of Sub-Inspector, pursuant to Advertisement dated 03.02.2021, but his candidature has been rejected on the ground that height of petitioner is less than 168 cm, which is standard and required height for the post in question.
3. Petitioner claimed relaxation in height, alleging inter alia that petitioner resides in hilly area and as per the Advertisement, for
[2025:RJ-JP:20340] (2 of 2) [CW-2380/2024] the candidates belonging to “Pahadi” area, the requisite standard height is only 160 cm.
3. Indisputably, in the online application form, available on record as Annexure 2, petitioner did not apply under the category of "Pahadi" area. At the later stage, when his candidature has been declared ineligible due to short of height, he wants to claim benefit of relaxation in height alleging himself to be belonging to
"Pahadi" area, stating inter alia that he resides in a hilly area. In the opinion of this Court, such a change of stand of petitioner apparently is afterthought and seems to be taken only to gain benefit of relaxation in height. If, indeed petitioner belonged to
"Pahadi" area, he should have applied in the same category in his online application form. After rejection of his candidature, he cannot be permitted to change the category and his claim to grant relaxation in height, does not seem to be genuine.
4. In view of above, the writ petition is devoid of substance and same is hereby dismissed.
5. Stay application and other pending application(s), if any, stand disposed of.
