ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by Petitioners/A2 and A3, seeking regular bail, in Crime No.410 of 2024 of Duwada Police Station, VIsakhapatnam Commissionerate. 2, A case has been registered againStthe Petitioners and anOtherfOrthe offences punishable under sections 20(b)(ii)(C), 8(c) read with 25 of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution in brief, iSthatOn 01.12.2024 at5.00 p.m., on receipt of credible information regarding illegal possession and transportation of ganja, the sub-Inspector of Police along with staff and mediators, rushed to Mangalapalem junction, Duwada and found three persons in suspicious circumstances with plastic bags in their possession. on interrogati6n, the said persons disclosed their identity Particulars aS that of Al to A3 and police found 40 kgs Of ganja in two bags Which Were in their possession. police seized the vehicle and the COntraband, arrested the accused and got them remanded to judicial custody on 01.12.2024 itself and since then they are in judicial custody. 4. Heard. Perused the record. 2 5. Learned Assistant Public prosecutor submI-tS that major Part Of the investigation is completed and charge sheet could not be filed for want of inventory. 6. A perusal of the material available on record goes to show that the Petitioners Were arrested and got remanded to judicial custody on 01.12.2024. The allegation is that police, on credible information, arrested the accused and seized 40 kgs of ganja from the possession of the Petitioners and another accused. The petitioners/A.2 & A.3 are languishing in J'ail from 01.12.2024. Learned Assistant public Prosecutor submits that there are no antecedents insofar as petitioners are concerned. 7. ln vI'eW Of the aforesaid facts and cl'rcumstances of the case, this Court is inclined to grant bail to the petI-tiOnerS/A2 and A3 herein, on the following conditions. (i) The petl'tioners/A2 and A3 herein shall be released on their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the learned I Addl'tionaI District and Sessions Judge-Gum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam; (ii) On release, the petitioners shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10,00 a.m. and 05.00 p.m., till filing of charge sheet. 8.
